{"id":13301,"date":"2022-06-03T18:59:38","date_gmt":"2022-06-03T23:59:38","guid":{"rendered":"https:\/\/eblaw.com.mx\/?p=13301"},"modified":"2023-01-02T10:53:17","modified_gmt":"2023-01-02T16:53:17","slug":"la-carta-de-renuncia-como-prueba","status":"publish","type":"post","link":"https:\/\/eblaw.com.mx\/en\/la-carta-de-renuncia-como-prueba\/","title":{"rendered":"LA CARTA DE RENUNCIA EN UNA CONTROVERSIA LABORAL"},"content":{"rendered":"<p class=\"has-medium-font-size\">La Ley Federal del Trabajo es una norma que trata de proteger primordialmente los derechos de los trabajadores, derivado de la larga historia de desigualdad que siempre ha existido con el patr\u00f3n. Es decir, es una ley en pro de la clase obrera.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">En muchas ocasiones cuando un patr\u00f3n contrata a un trabajador suele obligarle a firmar documentos en blanco o su carta de renuncia de forma anticipada para no pagar la liquidaci\u00f3n por concepto de despido injustificado, en caso de que exista un problema con el trabajador y decida despedirlo. <\/p>\n\n\n\n<p class=\"has-medium-font-size\">Todo lo anterior, es una practica <strong>totalmente ilegal<\/strong>.  <\/p>\n\n\n\n<h2 class=\"has-medium-font-size wp-block-heading\" style=\"font-style:normal;font-weight:500\"><strong>\u00bfQu\u00e9 es la carta de renuncia?<\/strong><\/h2>\n\n\n\n<p class=\"has-medium-font-size\">Podr\u00edamos definir a la carta de renuncia como el documento por medio del cual el trabajador notifica al patr\u00f3n que es su voluntad terminar la relaci\u00f3n de laboral, siendo \u00e9sta de forma unilateral sin responsabilidad para la empresa.   <\/p>\n\n\n\n<p class=\"has-medium-font-size\">Para efectos de una controversia laboral, la carta de renuncia se vuelve un elemento probatorio central para la emisi\u00f3n del veredicto final. <\/p>\n\n\n\n<h2 class=\"has-medium-font-size wp-block-heading\" style=\"font-style:normal;font-weight:500\"><strong>\u00bfQu\u00e9 dice la Suprema Corte de Justicia de la Naci\u00f3n al respecto?<\/strong><\/h2>\n\n\n\n<p class=\"has-medium-font-size\">La SCJN dictamino que para que la carta de renuncia sea considerada como una prueba fidedigna en una controversia laboral,  el patr\u00f3n debe de indicar que:<\/p>\n\n\n\n<ul class=\"has-medium-font-size wp-block-list\"><li>El documento existe por escrito y en original, y <\/li><li>Contiene los elementos de certeza id\u00f3neos para reflejar, <strong>convincente y congruentemente<\/strong>, la voluntad, la autonom\u00eda y espontaneidad del trabajador para terminar la relaci\u00f3n laboral. <\/li><\/ul>\n\n\n\n<p class=\"has-medium-font-size\">Mientras que el trabajador debe probar que la carta de renuncia se obtuvo a trav\u00e9s del:<\/p>\n\n\n\n<ul class=\"has-medium-font-size wp-block-list\"><li>Enga\u00f1o, coacci\u00f3n o intimidaci\u00f3n f\u00edsica, moral o econ\u00f3mica, y<\/li><li>Aportar o <strong>dar indicios<\/strong> que permitan considerar cuestionable e incierto el consentimiento que le es atribuido en la terminaci\u00f3n de la relaci\u00f3n laboral.<\/li><\/ul>\n\n\n\n<p class=\"has-medium-font-size\">Lo anterior podr\u00eda evidenciarse a trav\u00e9s de videos, fotograf\u00edas, documentos, testigos etc. <\/p>\n\n\n\n<p class=\"has-medium-font-size\">Si te interesa conocer mas acerca de c\u00f3mo elaborar una carta de renuncia correctamente acude con nosotros.
