{"id":14111,"date":"2026-06-05T13:26:56","date_gmt":"2026-06-05T19:26:56","guid":{"rendered":"https:\/\/eblaw.com.mx\/?p=14111"},"modified":"2026-06-05T13:29:42","modified_gmt":"2026-06-05T19:29:42","slug":"recuperacion-de-inmueble","status":"publish","type":"post","link":"https:\/\/eblaw.com.mx\/en\/recuperacion-de-inmueble\/","title":{"rendered":"Caso de \u00e9xito: recuperaci\u00f3n de inmueble mediante negociaci\u00f3n"},"content":{"rendered":"<h2 class=\"wp-block-heading\">El problema<\/h2>\n\n\n\n<p>Uno de nuestros clientes enfrentaba una situaci\u00f3n que suele ser m\u00e1s com\u00fan de lo que parece: una persona ocupaba una parte de su inmueble sin contar con un t\u00edtulo jur\u00eddico que justificara su permanencia.<\/p>\n\n\n\n<p>Durante a\u00f1os, la ocupante permaneci\u00f3 en el predio sin acreditar la existencia de un contrato de arrendamiento, contrato de compraventa, comodato o cualquier otro documento que le otorgara un derecho leg\u00edtimo para permanecer en el lugar.<\/p>\n\n\n\n<p>Ante esta situaci\u00f3n, nuestro cliente buscaba recuperar la posesi\u00f3n de su propiedad de manera efectiva, evitando riesgos legales innecesarios y procurando una soluci\u00f3n que no implicara un litigio prolongado.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">La estrategia legal para recuperar el inmueble<\/h2>\n\n\n\n<p>El primer paso consisti\u00f3 en iniciar los medios preparatorios correspondientes para requerir a la ocupante que acreditara el fundamento jur\u00eddico de su estancia en el inmueble.<\/p>\n\n\n\n<p>Al no demostrar la existencia de un derecho que justificara su posesi\u00f3n, se procedi\u00f3 a promover las acciones legales procedentes mediante una controversia de arrendamiento.<\/p>\n\n\n\n<p>La estrategia no estuvo enfocada \u00fanicamente en obtener una resoluci\u00f3n judicial favorable, sino en generar las condiciones adecuadas para alcanzar una soluci\u00f3n pr\u00e1ctica y eficiente para nuestro cliente.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">El resultado<\/h2>\n\n\n\n<p>Durante la audiencia de conciliaci\u00f3n, las partes lograron alcanzar un acuerdo mediante el cual la ocupante se comprometi\u00f3 a desocupar voluntariamente el inmueble dentro de un plazo determinado.<\/p>\n\n\n\n<p>Gracias a este acuerdo:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Se evit\u00f3 un litigio prolongado.<\/li>\n\n\n\n<li>Se redujeron significativamente los costos legales futuros.<\/li>\n\n\n\n<li>Se disminuy\u00f3 el riesgo procesal para ambas partes.<\/li>\n\n\n\n<li>Nuestro cliente recuper\u00f3 la disponibilidad de su inmueble en un plazo razonable.<\/li>\n\n\n\n<li>Se evit\u00f3 la necesidad de continuar con diversas etapas procesales que habr\u00edan implicado tiempo y recursos adicionales.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">La lecci\u00f3n: negociar tambi\u00e9n es ganar<\/h2>\n\n\n\n<p>Muchas personas consideran que el \u00e9xito de un abogado consiste \u00fanicamente en obtener sentencias favorables. Sin embargo, en materia inmobiliaria, una negociaci\u00f3n estrat\u00e9gica puede generar mejores resultados que un litigio de varios a\u00f1os.<\/p>\n\n\n\n<p>La funci\u00f3n de un abogado no
